Under (720 ILCS 5/24-1.6(3), unless you are on your own land, residence or place of business, you may be charged with a UUW felony if:

UUW is considered a class 4 felony that can carry up to three years in prison - probation may be available as an alternative to prison depending on your criminal history.

If you have a recent conviction - the case can be a class 3 felony or higher with a minimum sentence of 2 years in prison.

FOID CARD REQUIREMENTS: All Illinois residents are required to have a valid Firearm Owner's Identification (FOID) card issued by the Illinois State Police (430 ILCS 66/1) to own a firearm. There are exceptions to Illinois FOID card requirements (430 ILCS 65/2(b), such as for nonresidents. The general requirements for obtaining a FOID card after a background check are:

You must not, within the last five years, have been a patient in a mental institution or part of a treatment facility for psychiatric treatment;

In the year prior to your FOID card application, have you used or been addicted to any controlled substance or narcotic;

You do not have an existing protection order, or a No Contact or Fighting Order has been filed against you;

Within the last five years, you have not been convicted of Battery, Aggravated Assault, Assault, Violation of a Protective Order, or a similar offense involving the use or possession of a firearm;

With a FOID card, you can legally ship your firearm if: 1) the firearm is in an inoperable condition; or 2) unload, in one condition you have a valid FOID card, or 3) carry or possess a firearm under the Firearm Transportation Act.

If you are licensed under (1) the Firearms Act (430 ILCS 66/1 and 2) and have a FOID card (430 ILCS 65), you may carry a concealed firearm on your person or in your vehicle. However, private companies and public institutions may ban weapons on their premises. This is why you will notice that some businesses have posted signs on their property entrances warning you that guns are not allowed on their property. On the other hand, if you only have a FOID card, you can physically carry or transport your gun if it is unloaded and in a case. If the firearm is in your vehicle and you only have a FOID card, if the firearm is not stowed, loaded and directly accessible, it is a Class 4 felony under Section 720 ILCS 5/24 - 1.6.

Under 720 ILCS 5/24-1(b), certain charges of Unlawful Use of a Weapon (UUW) are felonies punishable by up to one year in prison and a $100,000 fine. 2,500.
